This legal notice applies to all purchases made by you through the website under the domain name RAINBOWLIGHTHOUSE.NET (the “website”). By offering to purchase products through the website you are entering into an agreement with Rainbow Lighthouse at 84 Church Street, Dromore, County Down, BT25 1AA, Northern Ireland on the terms and conditions set out below. These terms and conditions of sale are additional to and not a substitute for the general terms and conditions of use of the website which can be found HERE.
1. Purchase of products from Rainbow Lighthouse, Online.
COPYRIGHT OF PURCHASED GOODS:
All goods purchased from the Rainbow Lighthouse web site, and in particular meditations and music, may not be copied, reproduced, republished, downloaded, posted, used for commercial purposes, broadcast or transmitted to any third party without the prior written permission of Rainbow Lighthouse, whereupon, if approved, the appropriate licence may be granted.
All work is protected under Copyright and all rights belong to Roisin Campbell.
GROUP & FAMILY USE
When purchasing a Clearing Meditation for group or family use you first need to contact Rainbow Lighthouse. The details of the intended purchase will be passed to Roisin who will align a Clearing Meditation for the group. Roisin may need to discuss the circumstances before she can align the meditation. Rainbow Lighthouse warrants that it has the right to supply all products offered by it on the website.
In all other respects and to the maximum extent permissible, Rainbow Lighthouse make no other warranties or promises about the products, and any implied warranties are excluded.
1 a) Availability, prices and information on products
All products are offered for sale by Rainbow Lighthouse subject to availability. The price of the products shall be the price listed in UK pounds sterling on the website on the date of your order (inclusive of VAT & Excise Duty if appropriate, but exclusive of delivery charges which are payable by you). All prices displayed on the website are and must be paid in full, including delivery charges, except where discounts are offered as detailed on the website.
1 b) Ordering
When you click on the “Finish Button” on the “Checkout” page Rainbow Lighthouse will treat the order as an offer by you to purchase the products subject to these terms and conditions of sale. You are responsible for ensuring the accuracy of your order and any specific delivery instructions and if Rainbow Lighthouse accepts your offer they shall supply you, subject to availability, with the quantity and specification of products set out in your order.
If Rainbow Lighthouse accepts your offer they shall confirm each order online via the internet or by email and such confirmation shall be Rainbow Lighthouse’s acceptance of the contract between the parties.
1 c) Delivery & retention of title
All products will be delivered to the address that you indicate on the “Checkout” page and so far as possible in compliance with any specific delivery instructions, referred to above.
Whilst the risk of damage to or loss of the products shall pass to you the purchaser upon leaving the premises of Rainbow Lighthouse, title in the goods shall not pass until the whole purchase price including the cost of transport, has been paid in full.
Any times quoted for delivery are approximate only and time shall not be of the essence. Rainbow Lighthouse shall not be liable for any delay in delivery of the products howsoever caused.
Rainbow Lighthouse shall confirm each order in writing by sending you a printout of the order along with your products.
1d) Returns
If any of our products fall below the high standards you expect please return them within 28 days and we will refund or exchange the item. Please have your invoice with you to do this. If you change your mind within 28 days, we are happy to refund or exchange the product provided it is returned, as sold, with all the original packaging, tags, labels and accessories. Please have your order confirmation email with you to do this. We will not refund the costs of return postage to us unless the products are faulty.
You may not cancel your order if:-
(a) It is for products that are personalised, e.g. bearing specially personalised labels.
(b) Products that cannot be returned or are liable to deteriorate or expire rapidly.
2. Personal data
When you make a purchase from this website, the personal information collected enables us to process and deliver your order. By registering your details on our website, you consent to the recording, holding and using the personal data we collect about you. Nothing contained in this clause or elsewhere allows us to retain credit card details which we do not retain. We are committed to the Data protection legislation and completely dedicated to the privacy of our customers information.
3. Limitation of liability
Rainbow Lighthouse’s liability to you is limited to the price of the products purchased and the delivery cost involved and in particular is not liable to you for any indirect or consequential loss (including without limitation financial loss such as loss of profit, or otherwise) that you may incur as a consequence of its failure to comply with these terms and conditions of sale.
4. Changes to the terms and conditions of sale
Our terms and conditions of sale may be changed. Please review them regularly. If you continue to use the website after a change has been made you are deemed to have accepted it.
5. Retreats & Events
Deposits and Early Payments
Advance payments can be made in the form of ‘Deposit’ and ‘Early Payment’.
A deposit is the required advance payment that is required to secure a booking reservation for a retreat.
An Early Payment is money paid in advance of the event, after a deposit has been paid and is additional to the amount already paid as a deposit
All Deposits and Early Payments are non-refundable as they are used to book and secure services in advance on behalf of that person.
Final Payment
This is the payment of the balance remaining on the invoice for attendance on the retreat after the deposit and any early payments have been deducted. The Final Payment is the amount remaining to be paid after deducting the deposit and any early payments from the total due.
The date for the Final Payment (the balance due) will be shown on the invoice indicating the date when the full amount has to be paid. Failure to pay the balance due will result in the loss of the deposit and any early payments.
Insurance & Cancellations
All participants must have their own Travel Insurance to avoid loss as a result of change of venue, or date, cancellation of an event or a participant being unable to attend as a result of illness or family matters or any other reason that prevents them from attending an event which they have paid for either in deposit or in total.
Travel insurance is also to provide cover during attendance and the journey home.
Proof of personal Travel Insurance will be requested before each person joins the event and in the absence of Travel Insurance they will not be able to join Roisin.
Rainbow Lighthouse is not a travel agency and has no insurance cover for third parties / people joining Roisin on retreats or events. They are joining Roisin on her own journey and to be in her energy and she will only have her own personal travel insurance.
For cancellations, where a participant cannot attend for any reason, the following scale will be used to determine if a refund of the balance amount is due not the Deposit or Early Payment(s) and is subject to receiving notice in advance in writing. The date of cancellation will be the proven date of the receipt of the letter of cancellation.
- 28 days or more written notice in advance of the start of the event of cancellation – 40% of the Final Payment or balance will be the amount refunded.
- 27-14 days written notice in advance of the start of the event of cancellation – 20% of the Final Payment or balance will be the amount refunded.
- 13 and less days written notice in advance of the start of the event of cancellation – No refund.
- ALL DEPOSITS AND EARLY PAYMENTS ARE NON-REFUNDABLE
The first day of the event is deemed to be the start of the event and midnight on the last day of the event is deemed to be the end of the event.
6. Law and Jurisdiction
These terms and conditions of sale shall be governed by and construed in accordance with the laws of Northern Ireland. Any disputes arising in relation to the website shall be subject to the exclusive jurisdiction of the courts of Northern Ireland.
If any of these terms or conditions of sale should be determined to be illegal, invalid or otherwise unenforceable, it shall be deemed deleted and the remaining terms and conditions shall survive and continue to be binding and enforceable.
